Personal coaching agreement

Updated October 18, 2026. These terms describe personal coaching from Breno Melo Endurance Coaching LLC. Existing clients retain their previously agreed rights; new obligations are not applied retroactively merely by publishing this page.

Your coaching at a glance

  • You buy personal coaching from the LLC, not a guaranteed race result.
  • Your selected plan renews every 28 days: 13 payments per year, not calendar-month billing.
  • You can cancel future renewals at any time, without an exit fee or advance-notice requirement.
  • A temporary pause stops coaching and billing for agreed dates. A pause is different from cancellation.
  • We do not restart billing after a pause without your written confirmation.
  • Training carries risks, including serious injury or death. Read and separately acknowledge the risk release below.
  • Allowing us to use your image or testimonial is optional.

1. Parties, enrollment and service

This agreement is between Breno Melo Endurance Coaching LLC (the “LLC,” “we” or “us”) and the adult athlete identified in the enrollment record (“you”). Breno Melo and other personnel provide services on behalf of the LLC. This agreement does not create a partnership, employment relationship or personal guarantee of the LLC’s contractual obligations. It does not exclude anyone’s liability where law prohibits doing so.

Your checkout confirmation and written coaching arrangement identify your selected tier, price, service dates and delivery channels. Contact us if any detail is missing or unclear. The coaching start date is agreed after intake; any interval between advance payment and the agreed start is credited so that you receive the purchased 28 days of service. If we cannot agree a start date, we refund the unused advance payment.

Tier Recurring price Included support
Essential $250 USD every 28 days Personal plan, weekly review, email replies within one business day; no scheduled calls
Performance $350 USD every 28 days Personal plan, weekly review, weekday messaging with replies within 24 hours, monthly strategy call and TrainingPeaks Premium
Elite $750 USD every 28 days Personal plan, weekly review, same-day messaging seven days a week, weekly strategy call and TrainingPeaks Premium; four 60-minute in-person sessions total for local athletes, scheduled by agreement

Calls described as monthly follow the calendar-month schedule agreed with your coach. “Business day” means Monday–Friday excluding Massachusetts public holidays; scheduling uses America/New_York time unless agreed otherwise. Messaging is not emergency monitoring. We communicate planned absences and reasonable alternative coverage. No additional fee or upgrade is charged without your approval.

Race entry, travel, equipment, medical care and separately purchased services are excluded. Apex software and self-guided products have their own purchase terms; buying coaching does not automatically purchase a separate subscription. This adult agreement is not used for minors; a separately reviewed guardian arrangement is required.

2. Payment, renewal and refunds

Coaching is paid in advance. Your initial payment covers the first 28-day service period; the next payment, on day 29, covers the next 28-day period. You authorize the stated recurring coaching payment through Stripe every 28 days until you cancel. Cancellation does not create an additional payment for a period already paid for; a genuine outstanding balance for previously provided services remains due. The checkout and enrollment record must show the amount and next charge date. We provide receipts and legally required renewal notices. We do not store your full card number.

You may request a full refund of your first coaching payment within 14 days after your agreed coaching start date. You may also request a full refund before coaching starts. Email breno@brenoamelo.com with the account email and purchase reference. After that window, unused time is handled under the cancellation, pause and provider-termination provisions below. Nothing limits any refund or cancellation right required by law. Refunds are initiated within ten business days of an eligible request, or sooner where law requires; bank processing time varies.

An approved upgrade requires disclosure and approval of any prorated charge. A downgrade applies at the next renewal. Your rate remains unchanged during continuous coaching. After a nonmedical pause or cancellation, your previous rate remains available if you restart within 30 calendar days after active coaching ends, subject to availability. If the break exceeds 30 consecutive calendar days, the previous rate is not guaranteed. We disclose and obtain your written acceptance of the restart rate before charging you. Approved medical breaks are exempt from this 30-day rule for the agreed medical-pause period. We will give at least 60 days’ written notice before a proposed rate change affecting you, and you may cancel before it applies. Any consent required by law will be obtained.

Failed-payment notices identify the amount and how to resolve it. Coaching may be suspended after 14 days of unresolved nonpayment and ended after 30 days, following notice. Suspension does not authorize new charges for service we stop providing. We stop future renewals if we end the service. Amounts already lawfully owed for delivered service remain payable; no cancellation penalty is added.

3. Cancel future renewals

Cancel through the billing link in your client portal or email breno@brenoamelo.com from your account email. Include enough information to identify the account; no reason is required. Cancellation does not require a call, a coach’s approval, an exit fee or advance notice.

Cancellation is effective when submitted through the portal or received by email. We stop subsequent renewals. Coaching remains available through the paid-through date unless you request it stop earlier. Except for the satisfaction window or applicable law, ending participation early does not create a refund for the remainder of a normally delivered paid cycle.

We send written confirmation showing the service end date and that renewal is off. A delay in our acknowledgement does not delay cancellation. If an avoidable renewal is processed after a timely cancellation request, we reverse it. You may cancel even while a pause request is being reviewed or a pause is active.

4. Planned pause

For travel or another planned break, request a pause by email at least seven calendar days before the requested start. Include the start and expected return dates. We respond within two business days. Shorter-notice requests may be accommodated, but cancellation remains available without notice.

An approved planned pause may last 7–56 consecutive days, with 56 total planned-pause days per calendar year. Days are counted in the year they occur. This seven-day request period replaces the earlier 28-day planned-hold notice for coaching under these terms.

No coaching renewal, plan updates, routine workout review, calls or ongoing coaching messaging are provided during a pause. Billing support remains available. We retain your existing coaching records under our privacy and retention practices. Third-party premium features are not guaranteed during the pause.

A mid-cycle pause preserves unused paid service days. For example, a pause after ten days of a paid 28-day cycle leaves 18 paid days to use after restart. We do not collect a second full payment while those days remain. Written confirmation states the effective dates, remaining paid days, next-charge treatment and service availability. There is no pause fee.

5. Medical or injury pause

Tell us promptly if illness, injury, pregnancy-related needs or another medical condition prevents training. A medical pause has no advance-notice requirement and begins on the requested date, no earlier than receipt of your request unless we agree otherwise. You may stop unsafe activity immediately regardless of administrative confirmation.

Medical pauses may last up to 112 days per episode, separate from the planned-pause allowance. Billing stops and unused paid days are preserved on the same basis as section 4. We may request limited documentation of restrictions or ability to resume when reasonably necessary; do not send a full medical record or unnecessary diagnosis details. Any broader statutory cancellation or refund right takes priority over this policy.

6. Restart or end a pause

We contact you before the proposed return date. Billing and active coaching resume only after you confirm the restart in writing, including the start date, available service, remaining paid days and next charge. Updated intake or appropriate medical clearance may be needed for safe programming.

Rate protection follows section 2: nonmedical breaks longer than 30 consecutive calendar days do not guarantee the prior rate, even when within the planned-pause allowance. Approved medical breaks retain the prior rate for the agreed medical-pause period. A particular appointment time is not reserved. If we cannot resume within seven days of your requested return, you may choose an agreed later date or cancel and receive a refund of unused prepaid service days.

If you do not confirm a return by the allowance’s end, we end the coaching subscription without restarting charges, release the roster place, and refund unused prepaid service days. Returning after termination requires a new agreement and depends on availability. Pricing follows section 2, including the 30-day protection and approved medical exception; a medical-related cancellation must have its protected return arrangement confirmed in writing. We disclose this before you enroll again.

Unused-day refunds are calculated as the amount paid for the affected cycle multiplied by unused days divided by 28. We do not exchange unused coaching days for unrelated products without your agreement.

7. Safe participation and service limits

Give accurate information about your experience, availability and relevant limitations, and tell your coach about material changes. Obtain medical clearance before beginning or materially changing an exercise program. Coaching, general fueling education and software recommendations do not diagnose, treat or replace care from a licensed health professional.

Choose safe routes, conditions and equipment, obey event and traffic rules, and use appropriate supervision for activities such as open-water swimming. Do not continue a workout merely to satisfy a plan if symptoms, fatigue or conditions make it unsafe. For urgent symptoms or an emergency, stop and contact emergency services; do not wait for a coach or app reply.

Except during expressly agreed in-person instruction, we do not supervise activity in real time. Even during instruction, we cannot eliminate inherent risks. We do not promise a finishing time, qualification, weight change, injury-free season or other specific result. AI-generated suggestions can be incomplete or incorrect and should not override medical advice or immediate safety judgment. Optional AI and connected-health permissions are handled separately; this agreement does not provide blanket AI-data permission.

8. Important: assumption of risk and limited release

READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO BRING CERTAIN CLAIMS.

I understand that running, cycling, swimming, strength training, endurance events and related preparation involve risks, including falls, collisions, equipment failure, overuse injury, adverse weather, heat or cold illness, dehydration, drowning, cardiac events, permanent disability and death. I voluntarily participate and accept the inherent risks of the activities I choose, including risks that cannot be eliminated by reasonable care.

To the fullest extent permitted by applicable law, I release Breno Melo Endurance Coaching LLC and its members, employees and contractors acting in their coaching roles from claims for injury, loss or damage arising from my participation in the coaching activities covered by this agreement that are caused by their ordinary negligence. This includes death-related claims only to the extent the law permits their release.

This release does not cover gross negligence, reckless or intentional misconduct, or any duty, claim or remedy that cannot legally be waived. It does not require me to release another person’s independent rights where I lack authority to do so. I may ask questions before accepting. I understand that this is an assumption of risk and a limited release, not a guarantee that the activities are safe.

The risk release must be clearly presented for electronic acceptance before coaching enrollment; merely publishing this section does not establish that an athlete accepted it.

9. Privacy, content and conduct

We handle personal information under the Privacy Policy provided with enrollment. Access to health, workout and communication data is limited to authorized purposes. This agreement does not authorize public disclosure of health information or advertising use of your identity.

You may use your delivered training materials for your own training. Do not resell, publicly redistribute, share account access or use our materials to coach others without written permission. You retain ownership of content you supply; we may use it as needed to deliver the agreed service, subject to your privacy permissions. No automatic marketing license is granted.

We may stop an unsafe session immediately or suspend/terminate services for a material breach, harassment, fraud, nonpayment or safety concerns. We explain the action where appropriate, stop future renewals, and refund unused prepaid service days, subject to applicable law. We do not impose automatic forfeiture or an arbitrary per-incident penalty. We may pursue proven lawful claims separately.

10. Massachusetts law and changes

Massachusetts law governs, without taking away mandatory protections applicable where you live. Disputes may be brought in a court with lawful jurisdiction; this agreement does not require arbitration or waive a jury or class-action right. Please contact us first where practical, but doing so is not a condition that delays statutory remedies, emergency relief or filing deadlines.

For the coaching service, this agreement, when accepted, and the enrollment record control over inconsistent general website terms, including general media-release, arbitration and liability-cap language. Privacy notices and mandatory law continue to apply. We will not change this agreement retroactively by editing a webpage. Material prospective changes require notice and any legally required agreement. If a provision is unenforceable, the remaining provisions continue where lawful.

11. Website notice and athlete responsibilities

This Coaching Agreement is made available on our website so athletes can review and retain it before enrolling. You are responsible for reading the agreement, asking questions about anything you do not understand, and following the terms you accept. Contact breno@brenoamelo.com before enrolling if you need clarification or an accessible copy.

No paper signature or separately emailed signature form is required. For this agreement and its risk release to be accepted electronically, enrollment must provide a clear link and an affirmative acceptance action identifying the applicable version. The LLC must retain that record and provide access to a copy. Publication alone is not a substitute for this process.

Publication on our website, browsing, silence, or receipt of coaching information alone does not establish acceptance of a liability release, consent to new charges, or marketing permission. Material changes are communicated prospectively and any required acceptance is obtained; an updated webpage does not retroactively change an existing agreement.

12. Optional image and testimonial permission

We request separate written or electronic permission before using an athlete’s name, photograph, video or testimonial for advertising or promotion. No paper signature form is required, but permission must identify the approved material, attribution and uses. Joining coaching, sending a workout photo, posting feedback or reading this policy does not automatically grant marketing rights. Declining permission does not affect coaching or pricing.

When you expressly approve identified material, you grant the LLC a nonexclusive, royalty-free license for the agreed website and organic social-media uses. Paid advertising requires separate approval. No compensation is due unless separately agreed. Editing may adjust size, format or length but must not misrepresent your experience. Permission does not include private health information, messages or training records without separate authorization, or authorize voice cloning, synthetic likenesses or facial-model training. Rights belonging to photographers or other identifiable people must also be cleared.

Withdraw future permission by emailing breno@brenoamelo.com. We stop new uses upon receipt and remove material from channels we control within 30 days, sooner where legally required. Independent reposts, caches and previously distributed print materials may not be recoverable; we will not make new distributions after withdrawal.
